Budget 2023-24: Update on Australia’s Immigration Program

Budget 2023-24 Highlights

The labour has addressed critical skill shortages, driving innovation, and attracting investment as part of the 2023-24 Budget. The 2023-24 permanent Migration Program ceiling will be 190,000 places.

Federal Budget Highlights for Immigration

  • Around 70 percent of places in the 2023‑24 permanent Migration program will be allocated to skilled migrants, bringing long‑term fiscal and economic benefits and addressing persistent skill shortages. 
  • An extra 2 years of post‑study work rights have been provided to Temporary Graduate visa holders with select degrees, to improve the pipeline of skilled labor in key sectors. 
  • The Temporary Skilled Migration Income Threshold has been increased to $70,000 to ensure skilled migration settings are better targeted. 
  • International students working in the aged care sector have been exempted from the capped fortnightly work hour limit until 31 December 2023. 
  • Additional training places have been provided for Pacific Australia Labour Mobility scheme workers in priority sectors for the Pacific and Timor‑Leste and where there are job shortages in Australia. 
  • The Government will increase Visa Application Charges (VACs) from 1 July 2023. In addition to the regular CPI indexation, VACs will increase by 6 percentage points for visa applications, an additional 15 percentage points for select visitor and temporary visa subclasses, and an additional 40 percentage points for business innovation and investment visas. 
  • For the 2023–24 permanent Migration Program, the Government will return the planning level to the longer-term level of 190,000 places and will allocate 137,100 places (around 70 percent) to the Skill stream, helping address Australia’s longer-term skill needs. 
  • The Government will improve pathways to permanency for Temporary Skill Shortage (TSS) (subclass 482) visa holders. Restrictions will be removed to enable TSS visa holders on the short-term stream access to permanent residence pathways through the Employer Nomination Scheme (subclass 186) visa. The limit of one onshore renewal for the short-term stream TSS visa will also be removed. 
  • The Government will grant an extra two years of post-study work rights to international higher education graduates of Australian institutions with eligible qualifications to strengthen the pipeline of skilled labour. This measure will apply from 1 July 2023. The work hour cap for international student visa holders will be reinstated from 1 July 2023, following its removal during the COVID-19 pandemic. It will be increased by 8 hours from pre-pandemic levels to 48 hours per fortnight. 
    International students working in the aged care sector will be exempt from the 48-hour per fortnight work limit until 31 December 2023. 
  • These changes are in line with recommendations made in the report to the Government by the Post Study Work Rights Working Group in October 2022. 
    The increase to post-study work rights is estimated to increase receipts by $800.0 million and payments by $185.6 million, including a $185.0 million increase in GST payments to the states and territories over the 5 years from 2022–23. Bringing back the work hours cap for international students is estimated to result in an unquantifiable increase in receipts over the 5 years from 2022–23. 
 
 
2023-24 Migration Program

On 9 May 2023, the Australian Government announced that the planning level for the 2023-24 permanent Migration Program will be set at 190,000 places.

The 2023-24 Migration Program has been designed to address persistent and emerging skills shortages and support the transition to a net-zero emissions economy by attracting specialist skillsets that are difficult to find or develop in Australia. The Program has the following composition:

  • Skill stream (137,100 places) – this stream is designed to improve the productive capacity of the economy and fill skill shortages in the labour market, including those in regional Australia.
  • Family stream (52,500 places) – this stream is predominantly made up of Partner visas, enabling Australians to reunite with family members from overseas and provide them with pathways to citizenship. Of this stream:
    • 40,500 Partner visas are estimated for 2023-24 for planning purposes, noting this category is demand driven and not subject to a ceiling.
    • 3,000 Child visas are estimated for 2023-24 for planning purposes, noting this category is demand driven and not subject to a ceiling.
  • Special Eligibility stream (400 places) – this stream covers visas for those in special circumstances, including permanent residents returning to Australia after a period overseas.

Budget 2023-24 Program Size and Composition

The size and composition of the Migration Program are set each year alongside the Australian Government’s Budget process.

To inform the planning levels and policy settings of the 2023-24 Migration Program, consultation occurred widely with state and territory governments, representatives of academia, industry, unions, and community organisations.

When planning the Migration Program, the Australian Government  has considered the following:

  • Public submissions
  • Economic and labour force forecasts
  • International research
  • Net overseas migration, and
  • Economic and fiscal modelling.
State and territory nominated visa categories – nomination allocations

Under the Migration Program settings, nomination allocations are made available to States and Territories in the following visa categories:

  • Skilled – Nominated (subclass 190)
  • Skilled Work Regional (Provisional) (subclass 491)
  • Business Innovation and Investment Program (BIIP)

States and Territories each assess eligible applicants against criteria unique to their jurisdiction.

NT Skilled Migration Program 2022-23

NT Skilled Migration Program 2022-23

The  NT Skilled Migration Program 2022-23  is now open for both onshore and offshore applicants.

MigrationNT continues to receive and assess onshore nomination applications under the existing eligibility criteria. Applicants should lodge their applications as soon as possible after meeting the eligibility criteria. Applications may not be assessed prior to visa expiry dates. Those who have visas expiring should seek professional advice on their visa options and ensure that they remain lawful during their stay in Australia.

All applicants must ensure that they meet both the NT nomination criteria and the standard Home Affairs criteria at the time of lodging their nomination application and throughout their application process. It is the applicant’s responsibility to ensure that all documents including English test results, skills assessments, etc. remain valid.

 

Offshore applicants looking to apply for the NT Skilled Migration Program 2022-23 will generally only be nominated for a subclass 491 visa.

Offshore applicants must meet the minimum requirements above and meet the following NT nomination criteria:

  • Have post-qualification work experience of at least 1 year in your nominated occupation in the last 10 years,
  • Demonstrate a genuine commitment to live and work in the NT on a long-term basis,
  • Have evidence of financial capacity to settle in the NT and
  • meet criteria against one of the 3 streams below.

Please note: Those applying under the NT Family stream or the NT Job Offer stream can nominate any occupation on the national eligibility list

        • is an Australian citizen, an Australian permanent resident, an eligible New Zealand citizen or hold one of the following visas:

          • Skilled Regional (Provisional) visa subclass 489
          • a bridging visa granted in association with an application for a Skilled Regional Visa subclass 887 or Permanent Residence (Skilled Regional) subclass 191 visa
        • is usually resident in the Northern Territory, and has been living in the NT for at least 12 months
        • is the applicant’s eligible relative* or their partner’s eligible relative if their partner is also intending to apply for the same visa (see below for definition of eligible relative)
        • has confirmed in a statutory declaration that they are willing and able to provide settlement support to the applicant and migrating dependants including assistance with finding accommodation and employment in the NT 
      • have evidence of sustained efforts to seek employment in the NT, including evidence of research in to the NT job market, and sustained records of applying for jobs in the NT or making contact with NT employers 

    *an eligible relative must be the applicant’s or their spouse/partner’s:

      • parent
      • child or step-child
      • brother, sister, adoptive brother, adoptive sister, step-brother or step-sister
      • aunt, uncle, adoptive aunt, adoptive uncle, step-aunt or step-uncle
      • nephew, niece, adoptive nephew, adoptive niece, step-nephew or step-niece
      • first cousin, or
      • grandparents
  3. NT Job Offer Stream

    Offshore applicants under this stream must:

    • Have a verifiable job offer in their nominated occupation for a job that is based in the NT with an NT business / organisation that has been actively operating in the NT for at least 12 months

Onshore applicants looking to apply for  NT Skilled Migration Program  will have to meet the additional requirements .

Please note the following general information:

  • if you or any of your migrating dependants are currently living interstate, you will not be eligible for the Northern Territory (NT) nomination
  • if you or any of your migrating dependants are currently on a student visa and have not completed studies in an NT institution, you will not be eligible for NT nomination
  • if you have already been nominated for a subclass 489 or 491 visa by the NT, you will not be eligible for a subclass 190 nomination.
Additional requirements for onshore applicants

The Northern Territory (NT) Government grants nominations under the subclass 491 and 190 visas for individuals who meet the visa eligibility criteria set by the Australian Government’s Department of Home Affairs and can demonstrate strong employment outcomes in the NT and a long-term commitment to the NT workforce.

The NT Government considers a range of factors to inform decisions on applications for nomination. The following guidelines are intended to assist potential applicants, and are subject to change at the discretion of the NT Government. Each application will be assessed on its own merits. NT nominations are issued at the discretion of the NT Government, and meeting these guidelines do not guarantee a nomination.

Specific guidelines are provided for applicants in the following categories:

Eligible NT graduates

International student graduates who have studied in the NT will be eligible for a subclass 190 nomination if you have met the following criteria before applying for nomination:

  • successfully completed one or more qualifications after studying in the NT, at an NT-based institution for two years in a single tertiary course or a set of nested tertiary courses, and
  • lived in the NT for a period of at least six continuous months immediately after the date of completion* of your last qualification, while holding a visa that has no work limitations (graduates will be required to apply for a subclass 485 Temporary Graduate visa to enable this); the time spent on a bridging visa associated with a subclass 485 visa application can be counted in the six month period, and
  • demonstrated genuine and sustained efforts to obtain employment** from an NT employer in your nominated occupation or a closely related skilled occupation.

International student graduates who are unable to live in the NT for six months after completing two years of study in the NT will only be considered for a subclass 491 nomination. You must provide evidence of making genuine efforts to obtain employment** from an NT employer in their nominated occupation or a closely related skilled occupation.

You will be expected to demonstrate genuine efforts and progress towards being employed in the NT in your nominated occupation both during and after your studies. These applications will be considered on a case-by-case basis.

* Date of completion is the date on which you were notified that you have met all academic course requirements. This is the date when the final exam results or notice of course completion were available or published.

** Genuine and sustained efforts to obtain employment can be demonstrated through evidence of a number of applications made over a period of time for jobs in relevant occupations in the NT, and other supporting evidence such as membership in relevant professional associations, or positive feedback from industry contacts in the NT.

Other NT residents

An NT resident applicant includes those on temporary visas with work rights, currently residing in the NT.

NT resident applicants will be eligible for a subclass 190 nomination if you:

  • demonstrate that you have been residing in the NT for at least two consecutive years immediately prior to application
  • demonstrate that none of your migrating dependants are residing in another part of Australia, and
  • demonstrate full-time employment in the NT in an eligible occupation continuously for at least two years immediately prior to applying for NT nomination and demonstrate the employment is available for at least a further 12 months.

NT resident applicants will be considered for a subclass 491 nomination if you meet the following requirements:

  • applicants who started living in the NT prior to 1 July 2020, must:
    • demonstrate that you have been residing in the NT for at least six consecutive months immediately prior to application
    • demonstrate that none of your migrating dependants are residing in another part of Australia, and
    • demonstrate full-time employment in the NT in an eligible occupation for at least six consecutive months immediately prior to applying for NT nomination and demonstrate the employment is available for at least a further 12 months.
  • applicants who start living in the NT on or after 1 July 2020, must:
    • demonstrate that you have been residing in the NT for at least 12 consecutive months
    • demonstrate that none of your migrating dependants are residing in another part of Australia, and
    • demonstrate full-time employment in the NT in an eligible occupation for at least six consecutive months immediately prior to applying for NT nomination and demonstrate that the employment is available for at least a further 12 months.

An eligible occupation for this purpose is:

  • the occupation identified in the skills assessment (nominated occupation), or
  • an occupation that is related to the nominated occupation. In order to be related to the nominated occupation, the majority of time in the position must be spent on tasks that align with the skills and knowledge required to undertake the nominated occupation.

The employment must also meet the following additional requirements:

  • the position must be based in the NT, and the employer must have a record of trading in the NT for at least 12 months
  • positions that are based at serviced office spaces or involve hot-desking arrangements will generally not be considered favourably
  • you must be paid at market salary.

Applicants who have not been employed in an eligible occupation will generally not qualify for NT nomination.

Applicants who have been employed on a full-time basis for at least six consecutive months in an occupation that is not an eligible occupation may qualify for a subclass 491 nomination on an exceptional and case by case basis if you are able to demonstrate the following:

  • the employer has made genuine efforts to recruit locally and the position cannot be filled by an Australian citizen or permanent resident – at a minimum, evidence should include copies of advertisements placed, and a statement from the employer detailing the number of applicants and reasons as to why no Australian citizens or permanent residents have not been recruited
  • there is a genuine need for the position in the business – at a minimum, evidence should include a detailed statement from the employer explaining the need for the position and how the vacancy arose
  • you have made genuine and sustained efforts to obtain employment in your nominated occupation or a related occupation in the NT – at a minimum, evidence must include copies / screenshots of applications made for relevant jobs and any feedback received.

Applicants who are on a Temporary Work (Skilled)(subclass 457) or Temporary Skill Shortage visa (subclass 482) must provide a letter of support from your current subclass 457 or subclass 482 sponsoring business stating that they:

  • support your visa application
  • understand that you will not be tied to their business once the subclass 491 / subclass 190 visa is granted.

The NT Government may contact your employer. There may be circumstances where the need for support from your current employer can be waived.
