The Permanent Partner Visas (Subclass 801) and (Subclass 100) allow the de facto partner or spouse of either an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia permanently. It is usually only for people who currently hold a Provisional Partner Visa (Subclass 820) (Subclass 309).

What are the requirements for the Permanent Partner Visas (Subclass 801) and (Subclass 100)?

For Visa Applicants

  • You must hold a Temporary Partner Visa (Subclass 820) or (Subclass 309) if applying for the Permanent Partner Visa (Subclass 801) or (Subclass 100) respectively. Alternatively, you must hold a Dependent Child (Subclass 445) Visa if applying for one of the Permanent Partner Visas.
  • Two years must have passed since you applied for the combined 820 and 801 Visa, or the combined 309 and 100 Visa, unless exemptions apply.
  • You must be in a continuing relationship with the spouse or de facto partner who sponsored you for the Provisional Partner Visa, unless the relationship has been ended under special circumstances.
  • You must have abided by all the laws and conditions of the 820 or 309 Visa.
  • You must meet health and character requirements.

For Sponsors

  • You must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
  • You must be 18 years old or older.
  • You must meet the character requirement.
  • You must continue to be the applicant’s spouse or de facto partner.
