Family Visa – Australian Partner, Parent, and other visas

The Family Visa Stream facilitates the reunion of immediate family members of Australian citizens, permanent residents, or eligible New Zealand citizens. It also includes other members of the family, such as parents, orphaned relatives, and carers. The family visa  stream comprises of three main categories:

  • Partner Visas – These visas allow spouses, de facto partners (including same-sex partners), and fiancés to live in Australia with their partner.
  • Parent Visas – This category is designed for parents of settled Australian citizens, permanent residents, or eligible New Zealand citizens, to stay in Australia with their family.
  • Other Family Visas – This category includes dependent children, or step-children of the sponsor, a child adopted from overseas, orphan relatives, aged dependent relatives, remaining relatives, and carers.

What are the main requirements for family visas?

  • Applicants must be sponsored by an Australian citizen, permanent resident, or eligible New Zealand citizen.
  • Applicants must meet the necessary health and character requirements.
  • There are no skills tests or language requirements for family visas as there is for skilled migration visas.
  • Partner or fiancé sponsors are limited both by the number of applications they can make and the intervals between sponsorships.
  • Certain family visa applications may necessitate an Assurance of Support showing someone who can support the applicants financially to ensure the applicants do not become a financial burden on Australia’s welfare system.
  • In the case of the Parent visa category, applications are subject to a ‘balance of family test’, whereby more children must reside permanently in Australia than elsewhere for the parents to qualify.

What are the main types of family visas?

Provisional Partner Visas – Subclass 820 and 309

The Provisional Partner Visas allow individuals who are the spouse or de facto partner of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia temporarily. The Partner Visa (Temporary) (Subclass 820) or Partner (Provisional) Visa (Subclass 309) is granted first and allows the applicant to live in Australia for two years. During this two year period, the applicant can apply for a Permanent Partner Visa they wish to live in Australia permanently with their partner.

Permanent Partner Visas – Subclass 801 and 100

The Permanent Partner Visas (Subclass 801) (Subclass 100) allow individuals who are the spouse or de facto partner of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia permanently. For these Permanent Partner Visas, a combined application is lodged with the Provisional Partner Visa.

Prospective Marriage Visa (Subclass 300)

The Prospective Marriage Visa (Subclass 300) is granted to a person who is engaged and wants to get married to an Australian citizen, Australian permanent resident, or eligible New Zealand citizen. The visa allows the applicant to stay in Australia for 9 to 15 months and apply for the Partner Visa (Subclass 820 and 801) within that period if they wish to settle in Australia.

Sponsored Parent (Temporary) Visa (Subclass 870)

The 870 Visa allows Australian citizens, Australian permanent residents, and eligible New Zealand citizens to sponsor their parents for a temporary visa for up to three or five years. 

Parent Visas

Parent Visas allow parents of eligible Australian citizens, permanent residents, and New Zealand citizens to come live in Australia.

Child Visas

The Child Visas let children whose parents are an Australia citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia. There are 3 permanent child visa options which we can help you apply for – Child Visa (Subclass 101), Child Visa (Subclass 802) and the Adoption Visa (Subclass 102). Additionally, the Dependent Child Visa (Subclass 445) is a temporary visa option.
