Prospective Marriage Visa

The Prospective Marriage Visa (Subclass 300) is granted to people who are engaged and want to get married to an Australian citizen, Australian permanent resident or eligible New Zealand citizen. The visa allows the applicant to stay in Australia for 9 months to 15 months from the grant of the visa and apply for the combined Partner Visa application (Subclass 820 and 801) within that period of wanted.

What are the requirements for this visa?

For Visa Applicants

  • You must be 18 years old or older.
  • You must be outside of Australia at the time of application.
  • You must meet the relationship criteria. Your prospective spouse, in most cases, should be an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
  • You must be sponsored by your prospective spouse. They must be approved as a sponsor by the Department of Home Affairs, and you and your prospective spouse must have met face to face as adults since turning 18, and know each other personally.
  • Your immigration history and any past visa cancellations or application refusals may affect your eligibility for this visa.
  • You must meet health and character requirements.
  • You must repay or have arrangements to repay the outstanding debts to the Australian Government.

For Sponsors

  • You must be 18 years old or older.
  • You must be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen. If you are a New Zealand citizen and do not meet the eligibility criteria to sponsor for a Prospective Marriage Visa, your partner may be eligible for a New Zealand Citizen Family Relationship Visa (Subclass 461).
  • The Department of Home Affairs must approve your sponsorship for you to be able to sponsor your prospective spouse and any family members who apply with them.
  • You must meet character requirements. You might not be approved as a sponsor if you have a significant criminal record in relation to relevant offences, refuse to provide police clearance or do not consent to the disclosure of your convictions to the applicant.
  • Sponsorship limitations may apply under certain conditions.
